At Phalen Leadership Academies, we are committed to fostering a safe, inclusive, and welcoming environment for all students and families, regardless of immigration status. Recent changes in federal directives have raised concerns, and we want to assure our community that we stand with you and are taking every step to protect your rights and well-being.
Phalen Leadership Academies will cooperate with Immigration and Customs Enforcement (ICE) as required under the law. For the safety of our staff and children, we will require proper legal documentation from ICE or any other government agency to enter school facilities or buildings.
Our Commitment to Safe Spaces
Phalen Leadership Academies (PLA) is dedicated to ensuring that all students have the right to learn without fear. We have policies in place to protect the privacy and security of our students and staff:
- Protection Against Unlawful Searches and Seizures: PLA will not permit any enforcement actions by Immigration and Customs Enforcement (ICE) on school grounds without proper legal documentation unless required under the law
- Access to Trained Staff: Our team has been trained to respond appropriately to situations involving undocumented students and their families.
- Partnership with Legal Counsel: PLA collaborates with experienced legal advisors to ensure that all actions align with the law and protect our community.

It is essential for students and families to understand their rights. Here are key points to keep in mind:
- Your Privacy Matters: PLA does not ask about or disclose immigration status. We are committed to protecting the privacy of all students and their families, as required by federal and state law.
- Documents Required for Entry: Generally, ICE officers must present a valid warrant signed by a judge to enter school [non-public spaces] grounds. There are limited circumstances when ICE officers may enter non-public spaces without a valid judicial warrant, which will be reviewed on a case-by-case basis. Members of the PLA legal staff are trained to verify the validity of such documents.
- Access to Education: Every child has the right to attend public school regardless of immigration status under federal law (Plyler v. Doe).

Q: If arrested or detained, what are some of my rights?
Your rights:
- You have the right to remain silent. If you wish to exercise that right, say so out loud. (In some states, you may be required to provide your name if asked.)
- You do not have to consent to a search of yourself or your belongings, but police may pat down your clothing if they suspect a weapon.
- If arrested by police, you have the right to a government-appointed lawyer.
- If detained by ICE, you have the right to consult with a lawyer, but the government is not required to provide one. You can ask for a list of free or low-cost alternatives.
- You do not have to answer questions about where you were born, whether you are a U.S. citizen, or how you entered the country. (Different rules apply at international borders, airports, and for individuals on certain visas.)

Q: What should I do if I or my child are approached by ICE?
Stay calm and do not resist or obstruct the agents or officers. Do not lie or provide false documents. Prepare an emergency plan for yourself and your family in case you are arrested. Memorize the phone numbers of your family and lawyer. If you have children or need medication, make plans to ensure their care.

Q: How does PLA protect student information?
PLA strictly adheres to privacy laws, including FERPA (Family Educational Rights and Privacy Act), which safeguards student records. PLA may need to disclose student information pursuant to other laws. If PLA receives a request for the disclosure of student information, PLA legal staff are trained to handle such situations and will review the request to confirm whether such disclosure is required under applicable law.
